How long will my divorce take?

The length of any family law matter is dependent upon several factors, such as: the complexity of issues involved in the case, the level of the parties’ knowledge of asset and debt values, the responsiveness of the parties and their counsel in providing documents needed, the availability of court dates and mediation dates, etc. The fastest you can legally divorce in the State of Georgia is on the 31st day after the Defendant has been served with the action. While rare, there are divorce cases that span the course of 2 or more years. Typically, we tell our clients to expect the case to take between 6 months and a year. We will provide you with a more refined time estimate at an initial consultation where we discuss the specific issues involved in your case.

Can I kick my spouse out of the house before the divorce is final?

Typically, the home is entirely or partially marital property which is subject to equitable division. This is true even if the home is titled in just one spouse’s name. The marital residence is also usually the current residence of both spouses at the time of separation. You will need a court order to force a spouse to vacate the home before or after a divorce. This can be accomplished at a Temporary Hearing, where the Court addresses interim issues. Once a spouse has been granted sole and exclusive use and possession of the home by a court order, the other spouse will vacate the home and the remaining spouse may change the locks. We will explain whether or not we should pursue a Temporary Hearing in your matter at our initial consultation.

How much will my child support be?

Child support in Georgia is based upon the gross monthly incomes of the parties, the number of children involved, the number of overnights each parent has per year, and certain expenses of the children. In arriving at the final child support figure, we must use Georgia’s child support worksheet, which can be found online. Generally, the noncustodial parent pays the final monthly child support award determined by the worksheet as well as a percentage of the child’s healthcare expenses which are not covered by insurance and work-related childcare costs. The custodial parent pays everything else for the child. We will run some preliminary child support worksheets at our initial consultation to give you a better understanding of likely child support figures in your case.

How much will my family law case cost?

The fees involved in a family law matter are dependent upon the amount of work required. We take an initial retainer, which is based upon the level of complexity anticipated from our initial consultation. Typically, our retainer rates fall between $3,500.00 and $10,000.00. We bill hourly out of that retainer. When we run out of retainer funds, another retainer is required for continued work on the case. If the case resolves with retainer funds remaining, those funds are refunded back to the client. We send monthly invoices to clients so that there is transparency on all billing and expenses incurred. We also have case management software that allows us to provide clients with their real-time billing at any time. The easiest cases, which involve very limited issues, can resolve for $2,500.00 or less. The more complex contested child custody litigation, high asset divorce cases and divorce cases involving a spouse who owns one or more businesses, can cost $50,000 to $80,000.00 or even more. The most expensive cases we handle are modification cases. This goes to show how important it is to get your first order done right with the help of good legal counsel. In most cases we seek reimbursment of attorney’s fees from the opposing party. We are very frequently awarded fees for our clients.We will give you a better estimate of the total cost at our initial consultation.
